4. Limitation of Liability:
To the maximum extent permitted by law, Fashion Startup Advisors shall not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of our services. This includes, but is not limited to, loss of profits, business interruption, loss of business information, or any other financial loss. Even if Fashion Startup Advisors has been advised of the possibility of such damages, the liability of Fashion Startup Advisors shall be limited to the fees paid by the client for the specific services provided.
5. Confidentiality:
Each party shall maintain Confidential Information in strict confidence, and shall not use Confidential Information except (a) as necessary to perform its obligations under the Agreement, or (b) as required by a court or governmental authority. Confidential Information includes proprietary technical and business information, Preliminary Works, and any other information marked “Confidential.” Confidential Information does not include (a) any information that is in the public domain, (b) becomes publicly known through no fault of the receiving party, or (c) is otherwise known by the receiving party before obtaining access to it under this Agreement or properly received from a third party without an obligation of confidentiality.
6. No Endorsement:
Any reference to specific products, services, or entities does not constitute an endorsement or recommendation by Fashion Startup Advisors. Opinions expressed by Fashion Startup Advisors are based on our experience and expertise, but clients should conduct their own due diligence and seek multiple opinions before making decisions.
7. Changes to Services:
Fashion Startup Advisors reserves the right to modify or discontinue our services at any time without prior notice. This may include changes to the scope, content, or nature of our services. We will not be liable for any changes, interruptions, or discontinuation of our services.
8. Governing Law:
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Fashion Startup Advisors operates, without regard to its conflict of law principles. Any legal actions or proceedings arising from these terms shall be brought exclusively in the competent courts of that jurisdiction.
9. Cancellation Policy for Strategy Meetings:
For our 1-hour strategy meetings, cancellations must be made at least 24 hours in advance. If a cancellation is made less than 24 hours before the scheduled meeting, no refund will be provided. Clients are encouraged to reschedule their meetings to avoid this charge.
10. Digital Products:
All sales of digital products are final. Due to the nature of digital products, they are non-returnable and non-refundable once the order has been processed and the product has been delivered. Digital products are for personal or internal business use only and may not be reproduced, distributed, sold, leased, or shared with others. Any unauthorized use of digital products is strictly prohibited and may result in legal action. THE USE OR RELIANCE OF ANY INFORMATION CONTAINED ON THE SITE IS SOLELY AT YOUR OWN RISK.
